One of the scariest stretches for New York's dispensary owners had nothing to do with sales or taxes. It was a measuring tape. For several months, a quiet change in how the state measured the distance between a shop and a school threatened to shut down more than a hundred licensed businesses. Here's what happened, and where the rule stands today.
The problem
New York law says a dispensary can't sit too close to a school. For years, the Office of Cannabis Management (OCM) measured that buffer door-to-door, from the shop's entrance to the school's entrance. In summer 2025, OCM suddenly said it had been doing it wrong and would instead measure from the property line, a stricter reading that pushed many already-approved shops inside the forbidden zone.
The fallout was immediate. OCM sent letters to 152 impacted businesses, roughly 108 licensed dispensaries and 44 provisional-license applicants, many of them CAURD, justice-involved owners who had poured their savings into their shops.
The response
The backlash was fierce. Governor Kathy Hochul publicly called it a "major screw up," blamed prior OCM leadership, and said operating dispensaries would not be punished. Operators went to court, and in September 2025 a judge granted a preliminary injunction ordering OCM to revert to its earlier door-to-door guidance while the case played out.
The fix
The lasting fix came from the legislature. On February 11, 2026, Hochul signed legislation that codified the door-to-door standard and grandfathered in the licenses and applications caught up in the mess. The law makes the rule explicit: a dispensary can't be on the same street and within 500 feet of a school, or on the same street and within 200 feet of a house of worship, measured in a straight line from entrance to entrance.
Why it still matters
For New York's dispensary owners, the episode was a reminder of how much a single regulatory interpretation can shake a young industry, and how organized pushback and a fast legislative fix kept 152 small businesses open.
